The Nature and the Place of Presumptions in Law and Legal Argumentation.Raymundo Gama - 2017 - Argumentation 31 (3):555-572.
This paper explores two persistent questions in the literature on presumptions: the place and the nature of presumptions in law and legal argumentation. These questions were originally raised by James Bradley Thayer, one of the masters of the Law of Evidence and the author of the classic chapter devoted this subject in A preliminary treatise on Evidence. Like Thayer, I believe that these questions deserve attention. First the paper shows that the connection between presumptions and argumentation is a constant feature (...)

ABSTRACT The performance Un violador en tu camino [A rapist in your way] created by the Chilean feminist collective Las Tesis received global media attention during the 2019/2020 Chilean protests against inequality and human rights violations. Drawing on insights from Feminist Critical Discourse Studies, Corporeal Sociolinguistics and Multimodal Critical Discourse Studies, we analyse three video recordings of Las Tesis’ performances in three capital cities in Latin America: Santiago, Buenos Aires, and Mexico City. We study how sounds, lyrics, body movements, and (...)

Temporal Points of View: Subjective and Objective Aspects.Margarita Vázquez Campos & Antonio Manuel Liz Gutiérrez (eds.) - 2015 - Springer Verlag.
This book seeks to arrive at a better understanding of the relationships between the objective and subjective aspects of time. It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present, and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...)

    A Philosophical Approach to Folk Catholicism: A Collingwoodian Exploration.Raymundo Pavo - 2021 - Philosophia: International Journal of Philosophy (Philippine e-journal) 22 (2):218-229.
The principle of overlap of classes holds that when two entities interface, the effect is a blurring of boundaries between conceptual territories. In this paper, this question is in order: Is Folk Catholicism an instance of overlap of classes? If Folk Catholicism is not construed as such, these fallacies – using Robin George Collingwood’s perspective in his An Essay on Philosophical Method, may unfold: the fallacy of precarious margins, the fallacy of identified coincidents, and the fallacy of false disjunction. The (...)

    Between Collingwood’s and Croce’s Art-Theories: A Comparative Study.Raymundo R. Pavo - 2010 - Kritike 4 (1):79-93.
An initial study of Robin George Collingwood's The Principles of Art and Benedetto Croce's Aesthetic: A Science ofExpression and General Linguistic gives an immediate impression that Collingwood appropriated and incorporated many elements in Croce's work to his own position. This is probably the main reason why Collingwood, in his correspondence with Croce, sincerely expressed his gratitude to the Italian Philosopher for laying the foundation of his art-theory. Collingwood's acknowledgement of Croce's influence and the apparentsimilarity in their theories on art disposes (...)

  19. Rationality, Logic, and Heuristics.Raymundo Morado & Leah Savion - unknown
The notion of rationality is crucial to Computer Science and Artificial Intelligence, Economics, Law, Philosophy, Psychology, Anthropology, etc. Most if not all of these disciplines presuppose the agent's capacity to infer in a logical manner. Theories about rationality tend toward two extremes: either they presuppose an unattainable logical capacity, or they tend to minimize the role of logic, in light of vast data on fallacious inferential performance. We analyze some presuppositions in the classical view of logic, and suggest empirical and (...)

Software vulnerabilities are the root cause for a multitude of security problems in computer systems. Owing to their efficiency and tight control over low-level system resources, the C and C++ programming languages are extensively used for a myriad of purposes, from implementing operating system kernels to user-space applications. However, insufficient or improper memory management frequently leads to invalid memory accesses, eventually resulting in memory corruption vulnerabilities. These vulnerabilities are used as a foothold for elaborated attacks that bypass existing defense methods. (...)

    Inference and update.Fernando Raymundo Velázquez-Quesada - 2009 - Synthese 169 (2):283-300.
We look at two fundamental logical processes, often intertwined in planning and problem solving: inference and update. Inference is an internal process with which we uncover what is implicit in the information we already have. Update, on the other hand, is produced by external communication, usually in the form of announcements and in general in the form of observations, giving us information that might not have been available (even implicitly) before. Both processes have received attention from the logic community, usually (...)

A match made in heaven: predictive approaches to (an unorthodox) sensorimotor enactivism.María Jimena Clavel Vázquez - 2020 - Phenomenology and the Cognitive Sciences 19 (4):653-684.
It has been pointed out that Sensorimotor Enactivism, a theory that claims that perception is enacted and brought about by movement, says very little about the neural mechanisms that enable perception. For the proponents of the predictive approach to Sensorimotor Enactivism, this is a challenge that can be met by introducing predictive processing into the picture. However, the compatibility between these theories is not straightforward. Firstly, because they seem to differ in their stand towards representations: while Sensorimotor Enactivism is said (...)

On the Ethics of Imagination and Ethical-Aesthetic Value Interaction in Fiction.Adriana Clavel-Vázquez - 2022 - Ergo: An Open Access Journal of Philosophy 9.
Advocates of interactionism in the ethical criticism of art argue that ethical value impacts aesthetic value. The debate is concerned with “the intrinsic question”: the question of whether ethical flaws/merits in artworks’ manifested attitudes affect their aesthetic value (Gaut 2007: 9). This paper argues that the assumption that artworks have intrinsic ethical value is problematic at least in regards to a significant subset of works: fictional artworks. I argue that, insofar as their ethical value emerges only from attitudes attributable to (...)

The price of risk with incomplete knowledge on the utility function.Francisco J. Vázquez & Richard Watt - 2002 - Theory and Decision 53 (3):271-287.
When a risk is exchanged, the exact value for the minimum price (positive or negative) that the purchaser (investor, or insurer) is willing to pay is given by the certainty equivalent wealth level, which in turn depends on his specific utility function. When this utility function is unknown, then only a sufficient condition on the price can ever be found. This paper provides methods for calculating such a sufficient condition, when only limited information on the utility function is known.

Every so often an experiment trying to give reliable evidence for a metallic hydrogen solid is reported. Such evidence is, however, not too convincing. As Eric Scerri has recently reiterated, “the jury is still out on that issue” . This search stems from the common spectroscopy shared by the hydrogen atom and all the alkali metal atoms, and perhaps is guided by a desire to place hydrogen atop the alkali metals, in Mendeleiev’s Table, reinforced by the fact pointed out by (...)

Thinking the Event with Hannah Arendt.Rolando Vázquez - 2006 - European Journal of Social Theory 9 (1):43-57.
This article addresses the critique of the modern conception of history and time through a reading of Hannah Arendt. Arendt’s work provides an alternative to the thought with universal pretensions that has dominated the panorama of modernity. She thinks the historical through contradiction and gives a place to human experience next to facts. In thinking the event Arendt shows the insufficiency of the modern chronological appropriation of the past and the limits of using theory as a given framework of interpretation. (...)

The Diversity of Intrinsic Ethical Flaws in Fiction.Adriana Clavel-vázquez - 2020 - Journal of Aesthetics and Art Criticism 78 (2):143-156.
This article examines what constitutes an ethical flaw in artworks and asks which ethical flaws are relevant in determining works. ethical and aesthetic values. I argue that while most of the discussion has simply taken for granted that it is intrinsic ethical flaws that should be taken into account, there are further important differences in the type of intrinsic ethical flaws that artworks display. I identify two different types of ethical defects in artworks, fictional and actual, and argue that this (...)

Mobility Patterns and Experiences of the Middle Classes in a Globalizing Age: The Case of Mexican Migrants in Australia.Vazquez Maggio & Monica Laura - 2017 - Cham: Imprint: Springer.
The book presents insights from a mixed methodology study that examines recent mobility patterns exhibited by the middle classes. Its major contributions are two-fold: theoretically, it advances the conceptualisation of middle class migration; empirically, it analyses the migratory motivations of a relatively new Latin-American group in Australia. The accelerated insertion of the Mexican society into globalisation processes is strongly linked not only to the growing participation in migration phenomena but also to people's outflow to new destinations. Although studies of Mexican (...)

As a result of these discussions, this thesis tries to: produce a refined map of the main notions related to this subject, maintain that there can be a fault tolerant logic that stands in support of fault tolerant reasoning, and defend the use of deductive (...)
